1. Acceptance of Terms & Binding Agreement

By accessing, browsing, downloading, registering for, or using our website (www.untilgone.com), our mobile applications (iOS, Android, or other platforms), or any related services, APIs, social media channels, or features (collectively, the “Services”), you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you use the Services on behalf of a business, company, or third party, you represent and warrant that you have full legal authority to bind that entity to these Terms. If you do not agree to all of these Terms, you must immediately cease accessing and using the Services and uninstall any mobile applications.

2. User Accounts & Registration

• Account Creation: While you may browse product listings and public content as a guest, placing an order or accessing certain features requires creating an account (“Account”).
• Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You agree to provide accurate, current, and complete information and to promptly update your Account details as necessary.
• Account Deletion & Termination: You may request account closure at any time by contacting privacy@untilgone.com or utilizing the in-app account deletion features. We reserve the right to suspend or terminate Accounts, refuse service, or cancel orders in our sole discretion without prior notice if we suspect fraud, illegal activity, or violation of these Terms.

3. Mobile Applications & Mobile Messaging

• App License: Subject to your compliance with these Terms, UntilGone.com grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use a copy of our mobile application on a mobile device that you own or control, solely for your personal, non-commercial use.
• Device Permissions & Push Notifications: By downloading and using our mobile application, you consent to receive push notifications and allow access to device features (e.g., camera, location, local storage) as permitted by your device settings and our Privacy Policy. You can control push notifications through your device settings.
• App Store Terms (Apple & Google): You acknowledge that these Terms are between you and UntilGone.com only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the application, its content, maintenance, support, or warranty claims related to it. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to Apple-sourced apps and have the right to enforce these Terms against you.
• Mobile Messaging (SMS/MMS): If you opt into receiving text messages from us, you agree to receive recurring automated promotional and transactional messages at the mobile number provided. Consent is not a condition of purchase. Message and data rates may apply. You may opt out at any time by replying "STOP".

4. Orders, Pricing, Payments, & Shipping

• Order Acceptance & Cancellation: All orders placed through the Services are subject to product availability and our acceptance. We reserve the right to refuse, limit, or cancel any order for any reason, including inventory errors, inaccuracies in product pricing, or suspected fraudulent activity.
• Pricing & Typographical Errors: Prices displayed on the Services are in US Dollars and do not include applicable taxes or shipping charges. While we strive for accuracy, errors in pricing or descriptions may occur. In the event of a pricing error, we reserve the right to cancel any orders placed for the incorrectly priced product, even if the order has been confirmed and charged.
• Payments: Payment must be made through approved payment methods offered during checkout (e.g., major credit/debit cards, digital wallets, or third-party buy-now-pay-later services). You represent that you are authorized to use the chosen payment method.
• Shipping Limitations: Product deliveries are subject to shipping availability and carrier restrictions. Certain products may only ship to physical addresses within the United States (excluding P.O. Boxes, APO/FPO addresses, or specific states/territories as specified at checkout).

5. Returns, Refunds, Restocking Fees, & Warranties

• Cancellations: Orders may be canceled directly within your Account prior to order processing. Once an order enters processing, it cannot be canceled and must follow our standard Return Policy.
• Change-of-Mind Returns: Eligible items may be returned within thirty (30) calendar days of delivery. Returned items must be unused, unopened, in original packaging, and in working condition. Original shipping charges are non-refundable.
• Restocking Fee & Return Shipping: Return shipping costs back to UntilGone.com are the sole responsibility of the customer unless explicit pre-approval is granted in writing. If a return is inspected and determined to be fully functional, non-defective, or lacking original contents, a 15% restocking fee and initial shipping costs will be applied automatically.
• Final Sale & Non-Returnable Items ("Junk Boxes"): Certain items sold on UntilGone.com are explicitly non-returnable and non-refundable due to their clearance, promotional, or customized nature. This includes, without limitation: "Junk Boxes," Mystery Boxes, "Yours to Keep" items, personal health/hygiene products, intimate apparel, and digital media/gift codes. All sales for these items are strictly final, and no returns, exchanges, or credits will be provided under any circumstances once the order has processed.
• Defective or Damaged Products: If an item arrives damaged or defective, you must submit a return request within twenty-one (21) calendar days of the ship date. Approved defective returns must be received complete within fourteen (14) days of return authorization. Upon inspection, if the item is verified as defective, UntilGone.com will repair, replace, or refund the item at its sole discretion and waive the restocking fee.
• RMA Requirement: An approved Return Merchandise Authorization (RMA) number is mandatory for all returns. Returns received without a valid, pre-approved
• Product Display & Visual Disclaimers: We make every effort to display the colors, features, dimensions, and images of products available through the Services as accurately as possible. However, the actual visual appearance, color shade, dimensions, and texture of products displayed on your device screen may vary depending on your Internet browser, display resolution, color settings, or monitor quality. UntilGone.com does not guarantee that your device's display of any product appearance will exactly correspond to the physical product received.

5.1 Product Warranties & Third-Party Protection Plans (CPS)

Product warranties are specified on individual product listings and may be fulfilled directly by the original manufacturer or by UntilGone.com during the applicable standard warranty period.

6. Participating in Promotions, Contests, & Deals

We may post banners, advertisements, sweepstakes, contests, daily deals, flash sales, coupon codes, and other promotional offers (collectively, “Promotions”) throughout the Services or Mobile Apps. If we offer Promotions, they will be subject to any specific rules, official terms, and conditions communicated in connection with such offer (“Promotion Rules”). The Promotion Rules are considered part of these Terms and therefore part of the binding legal Agreement between you and us. In the event of any conflict or inconsistency between the specific Promotion Rules and these Terms, the specific Promotion Rules shall govern for that particular Promotion.

By participating in any Promotion, you agree to become bound by the applicable Promotion Rules. All Promotions are void where prohibited by law. We reserve the right to modify, suspend, or terminate any Promotion, coupon, or discount code at any time in our sole discretion without prior notice, including in the event of technical errors, unauthorized distribution, software glitches, or suspected fraud.

7. Third-Party Content, Advertisements, & External Links

The Services and Mobile Apps may contain advertisements, promotional offers, integrations, or links to third-party websites, mobile applications, services, or resources (collectively, “Third-Party Services”). Such links and content are provided solely for your convenience and information.

UntilGone.com does not control, endorse, monitor, warrant, or guarantee any Third-Party Services, nor the accuracy, completeness, or safety of any information, products, or services offered by third parties. Your interactions, purchases, correspondence, or dealings with any Third-Party Services—including payment processing, product delivery, warranties, or ad engagements—are solely between you and the applicable third party.

Access and use of Third-Party Services are conducted at your own risk and subject to the terms, conditions, and privacy policies of those third parties. UntilGone.com expressly disclaims any and all responsibility, obligation, or liability arising out of or related to your access to or use of Third-Party Services.

8. Affiliate Program & Marketing Relationships

UntilGone.com operates an affiliate marketing program (“Affiliate Program”) directly and via third-party affiliate networks. Participants in our Affiliate Program (“Affiliates”) and consumers purchasing through affiliate links agree to the following conditions:

• Affiliate Disclosure & FTC Compliance: Affiliates must clearly and conspicuously disclose their material connection to UntilGone.com on all websites, social media channels, emails, or platforms where affiliate links are published, in full compliance with the Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials in Advertising.
• Prohibited Affiliate Practices: Affiliates are strictly prohibited from engaging in predatory marketing practices, including bidding on trademarked terms, cookie stuffing, or publishing fake coupon codes.
• Commission Forfeiture & Termination: UntilGone.com reserves the right to immediately terminate any Affiliate account, void accrued commissions, and seek legal remedies for any violations.

9. Intellectual Property Rights & Copyright Policy

9.1 Ownership of Content and Services

The Services, including but not limited to the Website, Mobile Applications, software, code, databases, text, displays, graphics, photographs, video, audio, designs, and layout are owned by UntilGone.com, its licensors, or other providers and are protected by United States and international intellectual property laws.

9.2 Limited License and Restrictions

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use. You must not modify, reproduce, distribute, reverse engineer, or create derivative works from any part of the Services without explicit written consent.

9.3 DMCA Copyright Takedown Procedure

In accordance with the DMCA (17 U.S.C. § 512), if you believe your copyrighted work has been infringed on our Services, please submit written notice to our Designated Copyright Agent at legal@untilgone.com.

10. Permitted & Prohibited Uses

You agree to use the Services only for lawful purposes. You agree NOT to use bots/scrapers, introduce malicious software, disrupt network operations, or engage in fraudulent activities.

11. Termination, Suspension, & Enforcement

You may terminate your Account at any time by contacting privacy@untilgone.com or using in-app deletion settings. Upon termination, member-only areas will no longer be accessible.

UntilGone.com reserves the right, in its sole discretion and without prior notice or monetary liability, to suspend or permanently terminate your access to the Services or Mobile Apps for any reason whatsoever, including suspected breach of these Terms or illegal conduct. Upon termination, all licenses granted to you shall immediately cease.

We reserve the right without limitation to: (a) investigate any suspected breach of system security or network integrity; (b) investigate suspected violations of these Terms; (c) involve and cooperate with legal and law enforcement authorities; (d) prosecute violators to the fullest extent permitted by law; and (e) modify, suspend, or discontinue the Services or any portion thereof at any time.

12. Privacy Policy & Non-Personal Data Ownership

Your access to and use of the Services is governed by our Privacy Policy. By using the Services, you consent to our collection, use, and disclosure of personal data as described therein.

Notwithstanding anything in the Privacy Policy, UntilGone.com shall exclusively own all right, title, and interest in and to any non-personal, aggregated, de-identified, or synthetic data extracted, compiled, or generated from your access to and use of the Services, and may use such data for any lawful business purpose without accounting or compensation to you.

13. Disclaimer of Warranties & Limitation of Liability

THE SERVICES, MOBILE APPS, AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. UNTILGONE.COM DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

UNTILGONE.COM DOES NOT CERTIFY, WARRANT, OR GUARANTEE THE ABSOLUTE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR ADEQUACY OF ANY CONTENT, PRODUCT LISTINGS, SPECIFICATIONS, OR SERVICES AVAILABLE THROUGH THE WEBSITE OR MOBILE APPS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNTILGONE.COM, ITS PARENT (LEGATOS HOLDINGS INC.), AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. UNTILGONE.COM’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100.00 USD OR THE AMOUNT PAID BY YOU FOR THE ORDER GIVING RISE TO THE CLAIM.

14. Dispute Resolution, Mandatory Binding Arbitration, & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

• Informal Resolution: Before filing a claim, you agree to contact us at legal@untilgone.com and attempt to resolve the dispute informally within thirty (30) days.
• Binding Individual Arbitration: If unresolved, all disputes arising from these Terms or the Services shall be settled exclusively by individual, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
• CLASS ACTION WAIVER: YOU AND UNTILGONE.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
• Opt-Out Right: You have the right to opt out of arbitration by sending written notice to legal@untilgone.com within 30 days of first accepting these Terms.

15. Governing Law & Forum Selection

These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Washington, without regard to choice of law rules. To the extent court litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts sitting in Seattle, Washington.

16. Modifications to Terms & Contact Information

We reserve the right to modify these Terms at any time. Changes become effective thirty (30) days after posting on our Website and Mobile Apps. Your continued use signifies acceptance of the revised Terms.
